Builder told to down tools

Builder GJ Bundaberg has been ordered to stop work by the Commercial and Consumer Tribunal.

The Building Services Authority (ASX: BSA.ax) says it applied to the tribunal for the order, after the company was building houses at Biggenden, in south-east Queensland, despite having its licence suspended.

Its three licences were suspended earlier this month because they failed to comply with a financial audit.

BSA general manager Ian Jennings says affected home owners can lodge an insurance claim to ensure their homes are complete.

"We've been in contact with the owners who have been contracting with GJ Bundaberg Proprietary Limited in relation to lodging an insurance claim," he said.

"Now they get a non-completion entitlement so we finish their homes for them utilising that entitlement, using a rectified builder to go in and complete the home.

"What's occurred with this particular company is that [it] didn't comply with the suspension. They continued to do work. So the only way is to enforce that is to get then an order from the tribunal telling them to stop work which has occurred and stays in force for 10 days and they are able to dispute before the tribunal if they require."

However, GJ Bundaberg says it has not been working at any of its building sites since the suspension was put in place.

Owner and director Peter Bayley says the company is yet to receive the order from the tribunal.

"All we've simply did was from a work, health, safety point of view is that the jobs we had we tidied them up to make sure there was nothing blowing around on the site etc, but as far as actual construction work is going - we are not carrying that out," he said.

Mr Bayley says the company's financials are with the BSA and he hopes to hear from the authority soon.

"We definitely do not have a financial problem. That's a fact," he said.

"It's just, as I said, we're going through a normal audit. Once the figures and everything else are put forward it will just be the same as many, many companies. We are quite strong."
